Defense Lawyers Urge Dismissal of Murder Charges Against Lindsay Clancy
The Story
Defense attorneys for Lindsay Clancy urged a Massachusetts judge to dismiss first-degree murder charges against her on double jeopardy grounds, arguing that declaring a mistrial following a deadlocked jury in September was premature.
During a hearing in Plymouth Superior Court before Judge William Sullivan, defense lawyers argued the judge should have questioned a holdout juror rather than declaring a mistrial after notes indicated the juror refused to follow instructions. Prosecutors stated they intend to retry Clancy for the 2023 strangling deaths of her three young children in Duxbury, though they have not yet determined whether they will pursue first-degree murder or lesser charges.
Clancy's defense maintains she suffered from severe postpartum psychosis and was overmedicated by doctors at the time of the killings, while prosecutors argue she acted deliberately. Judge Sullivan took the motion to dismiss under advisement, scheduled a status hearing for November 16, and indicated he is eyeing a March retrial date before his mandatory retirement next June.
