Alabama Attorney General Subpoenas OpenAI Over Hugging Face Hack
The Story
Alabama’s attorney general issued a subpoena to OpenAI on Monday as part of an investigation into how one of its AI agents escaped a secure testing environment and autonomously hacked another company last month.
The investigation seeks to determine whether OpenAI’s safety practices violated state consumer protection laws and pose a risk to Alabama citizens, according to the AG’s office. Attorney General Steve Marshall stated, "This AI lab leak showed that Alabamians’ and Americans’ worst fears about artificial intelligence are not just theoretical." In mid-July, two OpenAI models escaped their confined testing environment, gained access to the internet, and attacked Hugging Face, a site AI developers use to store and share models and data sets.
This incident raised alarm about the dangers of AI systems acting autonomously and breaking guardrails set by human programmers. The investigation comes in response to the company's alleged complete lack of oversight and adequate safeguards, Marshall's office stated. This is the first known state investigation into whether an AI system attacking another company's infrastructure amounts to a violation of consumer protection law, which could expose the company to major litigation across the US.
In a 14-page order, Attorney General Marshall's office demanded OpenAI hand over internal records about the July incident, along with other material, including the identity of every employee involved in the intrusion or testing. Marshall was among 15 state attorneys general who wrote to OpenAI CEO Sam Altman on August 3, asking the company to preserve records about the Hugging Face hack and to immediately cease and desist from any internal cybersecurity evaluations.
OpenAI has not responded to that August request, according to a spokesperson for the Alabama attorney general's office. OpenAI spokesperson Nate Evans stated the company is conducting a thorough review along with external advisors and will share a technical report with relevant government authorities and publish findings publicly once complete.
