Representative Nancy Mace has stated that the Cornell student accusing seven fraternity brothers of rape was a willing participant in a consensual gangbang.

Mace posted on X that a consensual gangbang is not a rape, a message that has been viewed over 1.3 million times. Her lawyer, Thomas Giuffra, told The Post that Doe was in the early stages of processing the events, experiencing denial, shame, and acceptance. The texts revealed Doe writing "Our body our choice" and later stating she really liked being w u and matt.

The accuser's recollections reportedly changed after seeing group chats where she was advertised as free p, y and bragged about being part of an eightsome. One of the accused, Jonathan Newell, was listed as a trained event monitor for the party where the alleged incident occurred on October 19, 2024. University documents obtained by The New York Times indicated Newell was tasked with remaining sober and ensuring safety.

Doe alleged that by 1:45 a.m., Newell was snorting ketamine and having sex with her and another brother, and that she was too intoxicated to consent. Newell reportedly told investigators he did not arrive at the frat house until midnight and had been drinking at other parties. The Tompkins County District Attorney's office has reopened its investigation after initially declining to prosecute, citing Doe's original statement describing the drug use and sex as voluntary, conscious, and consensual. New York Governor Kathy Hochul appointed State Attorney General Letitia James as special prosecutor.
