Judge Rules Charlie Kirk Murder Suspect Tyler Robinson Will Stand Trial

An Utah judge ruled Tuesday that Tyler Robinson will stand trial on a capital murder charge, clearing the way for him to potentially face the death penalty.

Judge Tony Graf made a bind-over decision, determining there was enough credible evidence for a trial. Robinson, 23, pleaded not guilty to aggravated murder and six other charges related to the shooting. Prosecutors stated they possess a mountain of evidence against Robinson. Defense lawyer Richard Novak argued that Kirk expressed hateful views, a claim prosecutors countered by saying it helps prove their case.

The judge's ruling comes nine days before the one-year anniversary of Kirk’s killing. The Trump movement has used Kirk's death as a symbol and an emblem of vengeance for the MAGA movement. Judge Graf elaborated on the distinction between speculation and reasonable belief during the preliminary hearing, noting that a magistrate must find probable cause for a trial.

He explained that the prosecution's burden is light, requiring believable evidence of all elements of the crime charged. Graf also stated that magistrates can decline to bind over a case if the presented facts offer no more than a basis for speculation. This explanation was interpreted as a challenge to speculators who have offered theories without factual backing, such as Candace Owens' suggestions that an exploding microphone killed Kirk or that Robinson was not on campus.
