Justice Department Defends Trump's White House Media Ban in Court
The Story
The Justice Department claims President Donald Trump has the authority to bar CNN, Politico, and MS NOW from the White House on national security grounds.
The department urged a federal judge not to suspend the restrictions, stating in a late Tuesday court filing that access to the White House is a privilege, not a right. A hearing on the outlets' request for a temporary order restoring access is scheduled for Wednesday. CNN, MS NOW, and Politico filed a lawsuit on Monday, September 21, after Trump revoked their White House access on Friday, September 18.
They argue the restriction is a blatant violation of the First Amendment and their due-process rights. Trump announced the ban on Truth Social, accusing the outlets of "FAKE NEWS" and "FICTION and LIES." On Monday, September 21, major US television networks suspended their pooled coverage of Trump’s movements in solidarity. This led to Trump being inaudible during a helipad ribbon-cutting ceremony's live stream.
On Tuesday, Fox News Channel also declined pool coverage. The administration launched its own 24-hour "Trump TV" live stream on Monday, described as a greatest hits channel. Kaelan Dorr, deputy assistant to the president, said the press reported inaccurately or not at all on the Administration’s many record-breaking accomplishments. Trump TV debuted with 8,000 viewers, dropping to 2,242 about four hours later. Legal experts state the ban likely violates US legal prohibitions against viewpoint discrimination.
